AWARENESS FOR NATIVE AMERICAN RESERVATIONS
As a minority group, Native Americans experience extreme injustices by law enforcement. Native Americans have the highest death rate by police than any other racial or ethnic group in the country. The Black Lives Matter movement has brought needed recognition to the police brutality endured by Black Americans. However, the Native Lives Matter movement has gotten little to no press coverage on the staggering death rates of Native Americans caused by police shootings. On average, 2.9 out of one-million Native Americans die annually due to police shootings, and this is 12% higher than that of African Americans. In general, native American issues are grossly underrepresented by the press and media in this country.
Not only do Native Americans experience extreme police brutality, they are also incredibly overrepresented in U.S. jails and prisons. This is due to the fact that the incarceration rate for Native Americans is 38% higher than the national average. Not only this, but Native men are imprisoned four times more than white men, and Native women are jailed six times more than white women. Even minors are 30% more likely to be jailed than their white counterparts. Part of the reason for this is because serious crimes on reservations are under federal jurisdiction, which typically have more severe penalties than state jurisdiction. However, these mass incarceration rates would decrease if the government took action and funded child and family services on reservations. The government should also be funding tribal juvenile and addiction rehabilitation centers because alcoholism and drug addiction is prevalent on reservations. Unfortunately, the government has shown no interest in paying for these services. Because of this, the incarceration rates for Native peoples will only continue to increase.
The most unsettling statistics are the violent crimes against Native American women on reservations. Four out of ten Native American women have been sexually assaulted or raped, which is 2.5 times more than any other ethnic group. In addition, of the Native women that have been raped, 88% of them were raped by non-Natives. This is because rapists are aware of the jurisdictional loopholes on reservations. Because serious crimes on reservations are under the jurisdiction of federal courts, the tribal courts are not allowed to prosecute these offenders. Tribal courts are also not allowed to prosecute non-Natives for many crimes, such as sexual assault and rape. While federal courts are expected to handle these cases, they seldomly do, and many rapists know of this loophole. For example, a tribe in Minnesota experiences a noticeable increase in the number of rapes during hunting season. This illustrates the fact that rapists specifically target Native American women because they know that they will be able to get away with their crime.
Native American women are killed at a rate that is 10 times greater than the national average. Domestic violence can be deadly for Native women on reservations. Of the Native American women that are victims of domestic violence, roughly 81% of them are killed by their partners. There are no shelters for women to escape to, and often times, women are trapped in these abusive relationship due to poverty and cultural stigma. The abuser could not be prosecuted by the tribal courts until recently. This is because, in 2015, the Violence Against Women Act was changed to allow tribal courts to prosecute domestic violence offenders. Hopefully, this amendment to the current law will drastically cut the homicide rates resulting from domestic violence.
